By registering on the Platform, you confirm that you have read, understood, and accepted these Terms of Service and related policies, including but not limited to the Privacy Policy, Cookie Policy, and Payment and Fees Policy.

The use of the sellmycompany.io platform (“the Platform”) and user registration are governed by these Terms of Service. The Platform is operated by LITO CASE B.V., registered in Amsterdam, Netherlands, with headquarters at Sassenheimstraat 33-1, Amsterdam 1059BB. By registering and using the Platform, you agree to be bound by the following terms and conditions.

1. Acceptance of the Terms

1.1. By registering on the Platform, you confirm that you have read, understood, and accepted these Terms of Service, including all related policies such as the Privacy Policy, Cookie Policy, and Payment and Fees Policy.

1.2. If you do not agree to these Terms, please refrain from using the Platform.

1.3. The Platform operates as an independent intermediary (mandataire sans représentation), acting on its own behalf but not as a direct representative of the seller.

2. Eligibility for Registration

2.1. To register on the Platform, you must be at least 18 years old and legally capable of entering into binding contracts under Dutch law.

2.2. The Platform reserves the right to suspend or terminate access for users who do not meet eligibility requirements.

3. Account Creation and Verification

3.1. During registration, you must provide accurate and complete information. It is your responsibility to keep your account details up to date.

3.2. The Platform may request additional information or documents to verify users' identities and eligibility. Failure to provide such information may result in suspension of registration.

4. Subscription Plans and Fees

4.1. Different subscription plans offer varying levels of access and visibility. Fees and associated features are outlined on the Subscription Page.

4.2. Sales Commissions: By accepting these Terms, sellers agree that, if a business sale is completed through the Platform, a commission of up to 6% on the final sale price may be applied, as specified in the chosen plan.

4.3. All fees and commissions are subject to change with at least 30 days' notice to users.

5. Limitation of Liability

5.1. sellmycompany.io operates as an independent intermediary (mandataire sans représentation), facilitating connections between buyers and sellers but assuming no direct responsibility for the execution of contracts between parties.

5.2. The Platform is not responsible for disputes between buyers and sellers, nor for the accuracy of information provided by users. The Platform does not guarantee the success of any sale and is not liable for any financial or legal losses resulting from the use of the Platform.

6. Termination of Agreement and Account Cancellation

6.1. Users may cancel their accounts at any time by contacting customer support.

6.2. sellmycompany.io reserves the right to suspend or terminate user access in the event of a breach of these Terms.

7. Changes to the Terms of Service

7.1. The Platform may periodically update these Terms to comply with new regulations or improve the service. Users will be notified of such changes via email or through notifications on the website.

8. Governing Law and Jurisdiction

8.1. These Terms are governed by the laws of the Netherlands.

8.2. Any disputes arising from the use of the Platform shall be subject to the exclusive jurisdiction of the courts of Amsterdam.
